Terms and Conditions – Carbarn Cyprus

1. Introduction

These Terms and Conditions ("Agreement") govern the relationship between you (the "Purchaser") and Carbarn LLC ("Carbarn", "we", "us" or "our"), a Japan-registered company, in connection with the purchase and import of used vehicles from Japan to Cyprus.

Carbarn does not operate a local business entity in Cyprus. By using our website and purchasing a vehicle through us, you agree to these terms.

2. Nature of Business

  • Carbarn LLC is a Japan-based company engaged in the export of used vehicles, including to Cyprus.
  • All vehicle transactions, ownership transfers and export documentation are processed from Japan.
  • Carbarn's responsibility concludes on handover of the vehicle to the shipping line at the port of export in Japan.
  • Carbarn does not act as your customs agent in Cyprus and does not carry out registration with the Department of Road Transport on your behalf.

3. Eligibility and the Five-Year Import Limit

  • Cyprus admits cars and vans up to 5 years old, counted from the date of first registration.
  • Carbarn assesses eligibility from the vehicle's manufacture date, which is equal to or older than the first-registration age and is therefore the more conservative measure.
  • Transit from Japan to Cyprus takes 30 to 45 days, and customs clearance takes further time. Where a vehicle is close to the five-year boundary at the time of purchase, the Purchaser is responsible for satisfying themselves that it will still be within the limit when it is presented to the Cypriot authorities.

4. Governing Law and Jurisdiction

  • This Agreement is governed by the laws of Japan, and disputes are to be resolved in the courts of Japan.
  • Nothing in this clause removes any mandatory consumer protection to which you are entitled under the law of Cyprus or of the European Union.

5. Vehicle Condition and Inspection

  • Cyprus does not require a Japan-side pre-shipment inspection. Roadworthiness is tested in Cyprus on arrival, before registration.
  • Vehicles are sold on an "as-is" basis and the Purchaser accepts the vehicle's used condition.
  • Auction sheets, inspection reports, inspection comments, photographs and the auction grade are provided before purchase confirmation.
  • Odometer readings are reported as recorded on the auction sheet and the Japanese export documentation.

6. Shipping and Delivery

  • Vehicles are shipped from Japan by RoRo (Roll-on/Roll-off) vessel.
  • Destination ports are Limassol and Larnaca.
  • Sailings operate monthly, with a transit of 30 to 45 days, depending on vessel schedules.
  • Once the vehicle is handed to the shipping line, Carbarn is not responsible for schedule changes, port charges or delivery delays.

7. Payment Terms

  • We accept international bank transfer and credit or debit card.
  • Payment details are issued only on an official Carbarn proforma invoice after the quote is confirmed.
  • Bank charges, intermediary fees and exchange costs are the responsibility of the Purchaser.
  • Shipment is arranged only after the payment terms stated on the proforma invoice have been met.

8. Customs Clearance in Cyprus

  • The Purchaser is responsible for all procedures and costs relating to customs clearance, the roadworthiness test and registration in Cyprus.
  • Duty and VAT are assessed by the Cyprus Customs & Excise Department; registration is completed with the Department of Road Transport.
  • Customs duty is charged at 10% of the CIF value and VAT at 19% of the CIF value plus duty, with a fixed fee of €210. A lower rate of customs duty can apply where Japanese origin documents are available for that specific car; quotes are prepared at the standard rate.
  • The Purchaser is responsible for holding any importer registration that Cypriot customs requires in order to lodge the import declaration.

Documents supplied by Carbarn are:

  • Registration Certificate (Country of Origin)
  • Export Certificate
  • Original Invoice
  • Bill of Lading
  • Condition Report

9. Refund and Cancellation

  • Cancellation is possible only before shipment and is subject to confirmation.
  • Refunds are not granted once the vehicle has been shipped.
  • Any mandatory cancellation or withdrawal right you hold under Cypriot or European Union consumer law applies in addition to this clause.

10. Disclaimer and Limitation of Liability

  • Carbarn is not liable for port delays or demurrage charges.
  • Carbarn is not liable for the outcome of customs clearance, the roadworthiness test or registration in Cyprus.
  • Carbarn is not liable for damage, loss or mechanical condition arising after handover to the shipping line.
  • Nothing in this clause limits liability that cannot be limited under applicable law.

11. Privacy and Data Protection

  • We collect only the customer data required for order processing and export compliance.
  • Customer information is not sold, and is not shared with unauthorised third parties.
